I am regularly instructed in commercial, property and divorce cases. My work includes breaches of contract, insolvency, landlord & tenant litigation, and complex disputes over real estate. I frequently appear in the County Court as well as the Senior Courts. Outside of practice, I lecture on cruises about history.

Area of Law

Chancery

I am instructed in probate, inheritance and trust disputes, including TOLATA claims. This has included a case where the defendants were alleged to have breached their fiduciary duties as executors and trustees to the estate. I am regularly asked to advise on proposed claims, including in relation to professional negligence and restitution. In particular, I have advised on the merits of applying to the Supreme Court for permission to appeal in a wills case. I have successfully brought and defended bankruptcy petitions and has advised clients on whether they have grounds to set aside a statutory demand.

Commercial

In my commercial work, I have a wide-ranging practice. I defended a production company which was sued for breach of contract and advised clients on bringing an action against a wedding venue. I regularly advise on proposed claims, including in relation to restitution and misrepresentation. I recently advised on a large claim brought by one of the UK's largest charities under the Civil Liability (Contribution) Act 1978 at the High Court. I am instructed in costs disputes, having represented a pop artist in an application to set aside a default costs certificate, and has also fought cases brought under the Consumer Credit Act. I was junior counsel to Jacqueline Perry KC in an appeal at the High Court relating to unjust enrichment and the enforceability of a contract as well as the second appeal at the Court of Appeal.

Family

I represent clients in financial remedy proceedings. I recently obtained judgment for a large proportion of the equity in the family home, arguing my client’s short marriage should be considered within the context of five years of cohabitation. In opposing an application to vary a final order, I successfully argued that an increase in the maintenance should be limited to inflationary adjustments. I am experienced in making applications, including for third party disclosure orders and injunctions to prevent the sale of matrimonial assets. My understanding of family matters has assisted clients where their cases coincide with proceedings in chancery law. In addition to financial remedies, I have ample experience of child arrangement orders as well as non-molestation and occupation injunctions.

Landlord and Tenant

I often attend court for landlord & tenant cases, both residential and commercial. This includes multi-track possession hearings and a full gamut of injunctions. I successfully appealed in a case where a judge erred in law about whether a party was entitled to remain in the property. My residential work encompasses illegal eviction, disrepair, harassment and Equality Act claims, representing landlords, tenants, local authorities and management directors. Executors have frequently instructed me in landlord & tenant disputes brought prior to probate, combining my experience in both areas. My commercial work includes advising commercial tenants who seek relief from forfeiture, advising commercial landlords in relation to their grounds for possession, and drafting s25 notices.

Recent cases:

Ozbay v Bahcecioglu [2023], an appeal
The Claimant had been represented at first instance by someone acting under a power of attorney. Alexander, acting for the Appellant/Defendant, argued the Court had not properly considered the test for whether someone acting under a power of attorney should be able to address the Court, and it should not have been permitted. Also, the Claim Form had not set out the grounds for possession, contrary to the Civil Procedure Rules. The Appeal succeeded on both accounts.

Property

In my property work, I have acted for property owners and squatters, and my research has been published in the City Law Journal. This has encompassed obtaining injunctions in the High Court. I have assisted with boundary disputes as well as cases arising from property development regarding party wall agreements and the overriding of easements. I have been instructed in disputes over title, including one case where buyers did not register their title and the land subsequently passed to a third party. I recently advised 40+ households in relation to restrictive covenants at a property and the implications for a planning application. I frequently represent parties at the Property Chamber of the First-tier Tribunal in respect of variations of leases, service charge disputes and rent repayment orders.
