Alice Kuzmenko

Alice is a barrister specialising in clinical negligence, inquests, education law, and regulatory law. She has around five years of experience as a barrister. While based in London, she is willing to travel within England and Wales as may assist clients.

Since qualifying as a barrister, Alice has been working on cases with a medical focus.

Alice is adept at appearing in the SEND Tribunal, dealing with appeals in particular relating to children and young people’s EHCPs, including the contents of Sections B, F, and I, and decisions concerning the issuing and ceasing to maintain Plans. She also has experience in disability discrimination claims and judicial review arising from EHCP matters. She was the sub-editor of The Right to Inclusive Education in International Human Rights Law (Cambridge University Press 2019).

Alice brings her clinical negligence experience when representing clients at inquests, including acting for families, NHS Trusts, and medical professionals. Alice was instructed as junior counsel to the Guildford Pub Bombings Inquests and contributed to the second edition of ‘The Inquests Book: The Law of Coroners and Inquests’.

Alice has acted on behalf of Registrants and Regulators across a range of regulatory bodies, and in particular as concerns Interim Orders and substantive hearings.

Alice frequently appears in the SEND tribunal, dealing with appeals, in particular relating to children and young people's EHCPs, especially concerning:
* Sections B, F, and I of EHCPs
* Decisions around assessment for and issuing EHCPs
* Decisions around ceasing to maintain EHCPs

Alice also has experience in the SEND tribunal with claims of disability discrimination as concerns schooling.

She further has experience in judicial review matters arising from EHCP matters.

Alice's experience concerns regulatory bodies with a medical focus, such as the GMC, GDC, NMC, and HCPC.

Her work encompasses advice in the early stages of proceedings, such as concerns interim orders, through to final hearings.

What sort of work do I do?

I am able to advise, draft submissions and statements, and represent clients at hearings.
In all areas, I would advise on the process, next steps, and likely outcomes.

In education law, I draft position statements and can assist in amending working documents. Hearings would include Telephone Case Management Hearings and trials.

In inquests, I provide representation at Preliminary Inquest Review hearings and final/substantive inquest hearings. Where relevant, I draft submissions ahead of hearings.

For regulatory matters, I assist from the early stages of referral through to the final hearings before the relevant investigating committee. I draft submissions as appropriate to the differing stages of the process.

Who do I work for?

I am able to help parents and carers of children and young people with an EHCP, or looking to obtain one.

I represent bereaved families at Coroner’s courts, especially where there are concerns of potential clinical negligence that my require a claim following the inquest hearing.

I assist registrants across various medical regulatory bodies.
