Haresh is an experienced barrister specialising in Employment law (including regulatory law for medical doctors), Media law (including film, TV, defamation, and privacy), Education law and mixed selected Civil law (please enquire)

Before joining the Bar, Haresh qualified as a Solicitor and subsequently as a Solicitor Advocate at one of Nottingham’s best regional Law firms; Smalleys Solicitors. Consequently, Haresh understands the importance of tailor-made client care need which he provides using his spoken languages (Spanish, Hindi & Punjabi and intermediate Italian, and basic French) and by conducting home visits. Haresh offers his legal services to clients all over the U.K. (particularly Nottingham, Derby, Leicester, and surrounding areas of the East Midlands where he is based). He also advises ex-pats in Andalucía (Spain, particularly Sevilla) who have ongoing legal matters in the U.K. He has a unique skill set which makes him the perfect fit for a variety of Public Access instructions. Haresh has dealt with solicitor and client costs disputes over breach of retainer matters.
Haresh further advises on appealing costs orders. Moreover, he has experience in advising on costs awards which are brought before the Senior Courts Costs Office.

Defamation

Haresh has advised and represented clients up to the High Court in complex cases involving the Defamation Act 2013 concerning online broadcasts, social media statements and more.

Education

Haresh has extensive experience in the education sector as he is a fully qualified modern foreign languages Teacher and taught in Secondary schools in the East and West Midlands U.K. He has also taught in various A-level institutions and university courses and carried out exam marking. During his time as a teacher over 10 years, Haresh has dealt with many cases concerning parental orders, issues relating to MASH referrals, discrimination of students/pupils and other matters. Haresh has also often advised teachers involving union matters from regarding employment law. Haresh has advised and represented on a variety of internal hearings involving sensitive matters when it comes to children and education. Haresh is also able to advise on First-tier Tribunal (Special Educational Needs and Disability) matters. He is a keen advocate of ensuring childrens right to education is accessible. Haresh also advises Teachers facing misconduct matters involving the Teachers Regulation Agency. He has also assisted students in appeals to the OIA, (Office of the Independent Adjudicator).


Employment and Pensions

Haresh’s experience is drawn from personal and professional experiences in which he has advised and represent clients in several types of employment law cases. Haresh has considerable experience from the grievance/disciplinary stage, up to the Employment Appeal Tribunal & Court of Appeal (including but not limited) to settlement negotiations. Haresh has represented Claimants and Respondents in complex sex, race, gender, and religious discrimination claims (amongst other protected characteristics) which entail issues of whistleblowing, victimisation, and harassment for and against public bodies, companies, and health institutions (and more). Haresh has often advised on workplace bullying to a multitude of clients and advised on various dismissals. Haresh is a firm advocate of ensuring pleadings are drafted meticulously be it the ET1/ET3, acknowledgment of service, amendment applications, cost applications/responses, grounds for the notice of appeal or rule 3.10 applications. He also has wide experience in dealing with tampering allegations and using specialist expert evidence to manage these allegations in the Employment Tribunal. Haresh has also actively collaborated with employers in rectifying their equality (and other) policies to ensure they are compliant with the Equality Act 2010 and other laws. Haresh is often consulted on a variety of HR matters by employers.

Media and Entertainment

Haresh has experience in the world of film, as he also works as a documentary Filmmaker. He has advised Independent filmmakers on many legal issues which he learned during his MA in Filmmaking and the when his first feature film released in 2021 in Arc Cinemas and PAUS/Vimeo OTT platforms, 'My Nieces Big Fat Delhi Wedding. Through his film making journey Haresh has experience in advising (including but not limited to) on consent forms, crew member agreements and copyright issues when using other works in film projects. He also worked as a freelance journalist to the BBC and advised various on various broadcast issues for reporters, In the past, Haresh worked as an Actor and also advises performers on their contractual rights including those in the adult industry to ensure there consent is not misused in line with their contractual agreements and other matters.

Property

Haresh has advised and represented in various cases involving (including but not limited to) South Asian family disputes over property involving complex family / immigration and childcare issues.

Regulatory

Haresh has advised many medical doctors (including nurses and other professionals) at distinct stages of their career from junior up to senior/consultant levels. Haresh has also advised on how to deal with allegations of misconduct and how to manage suspension, and how to deal with bullying and discrimination. Haresh has represented at the Medical Practitioners Tribunal Service (MPTS).
