Direct Access Barrister
Jacqueline Paula Whelan
In Family Law, I represent parents and grandparents as both applicant and respondent in Child Arrangements Orders at all stages of proceedings, including initial, interim, finding of fact and final hearings.
In Education Law, I advise parents and children on how to access the support they need to access a full education in school/college/university via EHCP/IDP or IBP applications and support them to appeal decisions made not to assess/failure to issue/placement or provision including how to make the application to Tribunal and representation at Tribunal hearings. I have a proven record of success in challenging decisions made by Local Authorities, with decisions being overturned prior to Tribunal, getting the correct support in education quicker, saving time and costs.
What sort of work do I do?
Family Law - I advise on Children Act 1989 Private Law and Public Law and Family Law Act 1996 applications for both the applicant and the respondent, including; child arrangements orders, Prohibited Steps Orders, Specific Issues Orders, Occupation orders, Parental Responsibility Orders, Declaration of Parentage, Birth Certificate changes, Non Molestation Orders. I speak with clients directly, listen to what the issues are and advise accordingly. I provide written advice, meet with clients to go through the issues and attend Court. I prepare a hearing note ahead of the hearing, a note of the next steps.
Education Law - I advise and represent parents and children where they are struggling to secure the correct education for their child/themselves based on their Special Education Needs/Additional Learning Needs and or Disability. I also support clients where they are/believe their child/themselves to be experiencing Discrimination in education.
I advise at all stages of the process from initial applications for EHCP/IDP assessment, through the decision of refusal to assess, refusal to provide an EHCP/IDP or challenges to EHCP proposed school placement and/or challenges to provision. I meet with parents/children and Local Authorities and Health and Social Care providers to resolve disputes quickly, where possible.
