Jamal Demachkie

I am an experienced commercial barrister who specialises in property related work. I practice from Gatehouse Chambers in London.

My practice focuses on land and real property, including residential and commercial landlord and tenant work, having been involved in some of the leading cases in these areas. I am recommended in all of the leading legal directories and, in 2020, won the prestigious Real Estate, Environment and Planning Junior of the Year Award at the Legal 500 Awards.

In 2020 I was appointed as both a Deputy District Judge and Criminal Recorder (a part-time Circuit Judge) on the South Eastern Circuit. In 2021 I was appointed a specialist Chancery Recorder in the County Court.

I am the author of the definitive practitioner guide, 'Forfeiture of Leases'; published by The Law Society.

I practice in many areas of traditional chancery law (much of which overlaps with property law and the law of landlord & tenant), including:
- Trusts of Land and Co-ownership disputes (ToLATA claims)
- Partnership and Commercial disputes where the main assets are property-related
- Breach of trust claims

Landlord and Tenant

I act in a wide variety of landlord and tenant disputes, ranging from determinations of breach of residential leases in the FtT (First-tier Tribunal), to multi-million pound High Court claims between large corporate entities.

I have developed a niche practice in disputes concerning short-term holiday lets (having acted in the leading case of Nemcova v Fairfield Rents concerning Airbnb lettings in breach of covenant) and am co-author of the leading text book: 'Forfeiture of Leases' (Law Society Publishing, 2021).

Professional Negligence

I specialise in professional negligence claims in relation to property associated disputes, and am a contributory author of 'Risk and Negligence in Property Transactions' published by the Law Society in September 2018.

Property

I specialise in virtually all aspects of property law, including:
- Commercial and Residential Landlord & Tenant
- Development disputes (including rights to light, restrictive covenants, etc)
- Leasehold and leasehold management
- Real property (including covenants and easements, mortgage disputes, Land Registry adjudications, etc)
- Neighbour disputes (including boundary claims, party walls, rights of way and other easements, covenants, etc)

What sort of work do I do?

My practice focuses on land and real property as well as both residential and commercial landlord and tenant work, having been involved in some of the leading cases in these areas.

I also handle a variety of other claims with a property related element, ranging from arguments between beneficiaries to multi-million pound development projects and joint ventures where the main assets are property or property related.

My expertise also covers professional negligence claims in relation to property associated disputes, having acted for and against numerous legal and property professionals in matters concerning property transactions, advice and litigation.
