Direct Access Barrister

John Darren Declan Nee

A robust and user-friendly barrister specialising in family finance, Inheritance Act, private children (not care)) and wills & probate cases. in 2023 I set up Anvil Chambers.

I am recognised in the 2023 and 2024 Legal 500 Directory as a Leading Junior.

Kent courts (in person); any court (virtual). I occasionally travel to Essex, London, and Sussex but this is rare as my practice is Kent-centred. I am unlikely to take on cases outside of these areas unless virtual.

Area of Law

I frequently act in Matrimonial finance cases (including disputes over family businesses and freezing of assets); as well as acting for Cohabitants under the Trusts of Land and Appointment of Trustees Act 1996 (TOLATA) Act disputes. I am a matrimonial finance specialist, and act in the full range of cases, from limited asset to ultra high net worth.

I am an experienced Inheritance Act barrister - court and advisory work.

I have a broad child law practice (excluding care cases/ public law matters) which includes representing parents and grandparents in private law children proceedings from first appointment through to final hearings.

My cases have included Cohabitants in Schedule 1 children matters, permission to apply, and leave to remove, and I have acted on behalf of intervenors as well as applying for, and resisting, interim applications.

I deliver lectures and seminars to other lawyers.

I appear in all levels of court.

I have a reputation for giving clear and helpful advice, and my clients gain increased confidence from my robust and firm representation.

Wills and Probate

I have a particular interest in claims under the Inheritance (Provision for Family & Dependants) Act 1975, which straddle two of my main areas of work: contested probate, and family finance. I am happy to receive instructions in a wide range of cases in this area of law, including:
Disputes over the validity of Wills
Testamentary Capacity and undue influence
Deeds of variation and rectification
The liability of Estates, Executors and Personal Representatives
The construction of Wills
The validity of lifetime gifts
Trusts and the beneficial ownership of property
Non-contentious probate practice
I am comfortable advising on the law in this area – which can be complicated – as well as representing parties in court. Where appropriate, I will consider acting for more than one client (perhaps multiple siblings making a claim) in the same case by prior agreement.
