Direct Access Barrister
Lachlan Molesworth
I specialise in tax and revenue law, with particular expertise in international tax, transfer pricing, anti-avoidance regimes and tax treaty issues.
Before coming to the Bar, I practised as an international tax solicitor at a major international law firm. I have substantial advocacy experience in taxation trials and appeals before tribunals and higher courts.
I hold two master’s degrees with Distinction from the University of Oxford. These include the MSc in Taxation, for which I received the prize for the best overall performance and the prize for the best tax research paper.
My approach is analytical but practical. I aim to identify the important issues quickly, explain them in plain language and give clients clear advice about their options, prospects and the most proportionate way forward.
Area of Law
Commercial
I act in commercial and business disputes between parties.
Tax and Revenue
I am an experienced tax litigator and adviser.
What sort of work do I do?
I provide specialist advice, drafting and representation in tax and revenue matters, including:
• disputes, enquiries and investigations involving HMRC or another revenue authority;
• challenges to tax assessments, penalties and information requirements;
• tax appeals and related tribunal or court proceedings;
• international and cross-border tax issues;
• transfer pricing disputes;
• the application of tax treaties;
• anti-avoidance legislation; and
• complex questions concerning the interpretation and application of tax legislation.
I can be instructed at an early stage to advise on the merits of a position or dispute, help formulate a strategy and draft correspondence. I can also prepare written opinions, pleadings, grounds of appeal and written submissions, and provide representation at conferences and hearings.
Not every matter is suitable for direct access. If a solicitor or another professional is needed to conduct litigation or assist with evidence and case management, I will explain this at an early stage.
Who do I work for?
I accept direct instructions from individuals, entrepreneurs, company directors, privately owned businesses, partnerships and other organisations.
My clients also include multinational groups, private client and family interests, accountants, tax advisers and other professionals. I have experience acting both for taxpayers and for revenue authorities, which assists me in assessing disputes from each party’s perspective.
I welcome enquiries from clients based in the United Kingdom and overseas, particularly where a matter has an international or cross-border dimension.
