Direct Access Barrister
Marcia Duncan-Brown
I have a background in HR which goes hand in hand with Employment Law. I was called to the Bar in 2000 with a background in both the Criminal and Civil Courts up to appellate level, also whilst keeping a hand in Employment Law.
I have worked both in private practice and at the Bar. Working inside organisations has assisted in understanding the needs of both employers and employees.
I have represented a range of clients from individuals to household name companies. In doing so I have provided advice, drafted claims and responses, witness statements and representing clients in complex hearings of between 6 days in Tribunal and in preparing complex cases of 10 days duration . I am therefore able to offer well rounded and grounded experience.
I have been described as supportive, empathetic, caring, analytical, diligent and as having an eye for detail.
I am driven ultimately by providing a good service and more usually provide a fixed rate for tribunal hearings dependent on the case.
What sort of work do I do?
EMPLOYMENT LAW ONLY:
Direct Public Access, means I can more cost effectively assist you without the additional cost of a solicitor as well as do the work of a solicitor, if required. This latter function is an added benefit as not all barristers can provide this service unless granted by the Bar Council.
My work involves:
• Respondent and Claimant work.
• Oral and Written Advice – contentious and non-contentious eg Settlement Agreements, pre Tribunal advice. Advice to HR practitioners, including but not limited to CEO's of small, medium enterprises.
• Drafting; IT1’s/Particulars of Claim; ET3’s/Grounds of Resistance, Case Management Agendas, List of Issues, witness statements and skeleton arguments and grounds of appeal.
• Advocacy: case management discussion, preliminary hearings, full merit hearings.
Who do I work for?
My clients are HR practitioners, CEO's, and individuals: Claimants and Respondents.
