Direct Access Barrister
Robert Weatherley
I am specialist property practitioner. My practice encompasses the full range of real estate disputes across residential landlord and tenant law, commercial property and disputes over land (including rights of way, freehold covenants, adverse possession and boundary claims). I also deal with commercial disputes and professional negligence actions in the context of property (as for example the negligence of conveyancing solicitors). Recent work has included instructions to advise and represent litigants in the First Tier Tribunal (Property Chamber), the Upper Tribunal (Lands Chamber), the County Court and the High Court.
I am currently recommended by both of the main legal directories (the 'Legal 500'; and 'Chambers and Partners' guides). Outside of Chambers I am also the co-author of a textbook on property law ('Restrictions on the Use of Land', Wildy, 2024)
Area of Law
Commercial
I deal with commercial matters that arise, in particular, from the purchase of land. Such disputes include overage agreements and options for the purchase of land.
Landlord and Tenant
I provide and advocacy in relation to disputes concerning: service charges; rent repayment orders; forfeiture actions and other forms of possession claim (including claims involving the Equality Act 2010). In addition, I advise on leasehold enfranchisement and cases concerning a breach of covenant.
Professional Negligence
I advise in relation to the negligence of solicitors and other legal professionals. Much of my work in this context relates to poor advice given in connection with conveyancing.
Property
The majority of my practice involves disputes over land, in particular: rights of way, rights to light, the enforceability of freehold covenants, adverse possession claims and boundary disputes. In addition, I also regularly deal with issues that arise from co-ownership, namely disputes in relation to orders of sale and constructive and implied trusts
