Direct Access Barrister
Stephen Mallinson
I specialise in representing parents in contested child arrangements and high-conflict parenting disputes in courts throughout England and Wales at all levels up to and including the Court of Appeal.
I am ranked as a ‘Leading Junior’ by the ‘Legal 500’ and I appear in court daily at all stages of private children proceedings, including first hearings/FHDRAs, urgent applications, finding of fact hearings and final hearings.
I provide clear, strategic advice in conference as well as strong advocacy at Court for parents involved in difficult disputes about contact, residence, relocation and enforcement of court orders. I am frequently instructed in cases involving allegations of domestic abuse, parental alienation and entrenched breakdowns in contact.
I quickly gain the trust of my clients. I am praised for my calm, reassuring and empathetic approach which my clients find invaluable. My meticulous preparation and eye for detail enable me to get to the heart of the issues quickly and present my clients’ strongest case.
I guide clients through all stages of the Court process. I provide clear and strategic advice before applications have been issued. I advise clients on how to make and submit applications and witness statements.

Family
Stephen’s practice encompasses all areas of family law at all levels up to and including the Court of Appeal.
What sort of work do I do?
My practice includes applications for child arrangements orders, enforcement applications, applications to vary, specific issue orders, international relocation, internal relocation, occupation orders, non-molestation orders, prohibited steps orders and committal to prison.
I am regularly instructed to represent clients at urgent hearings.
I regularly deal with cases involving allegations of domestic abuse, alienating behaviours by parents (‘parental alienation’), intractable contact disputes, drug and alcohol misuse and neglect. I also deal with applications for shared care.
I regularly represent guardians.
I have experience of Schedule 1 Children Act 1989 proceedings, notably representing a premier league footballer.
I enjoy dealing with financial remedy proceedings at first appointments, FDRs and final hearings. I represent clients living within the jurisdiction and clients living overseas. I am experienced in the division of family homes, pensions, companies and property portfolios. I often deal with cases valued in excess of £1 million.
I represent clients alone and I’m often led by King’s Counsel. My cases involve the most serious allegations of non-accidental injuries, sexual abuse, domestic abuse, parental alienation, drug & alcohol misuse and change of residence.
Who do I work for?
I am qualified to accept instructions directly from members of the public under the Public Access scheme, through which members of the public can instruct me directly to receive expert advice and representation without going through a Solicitor in appropriate cases, saving them time and money. I will advise if your case is unsuitable.
Many clients instruct me throughout proceedings, benefitting from a consistent case strategy and consistent advocacy.
I travel nationwide, representing clients at Courts throughout England and Wales at all levels up to and including the Court of Appeal.
I am a member of Exchange Chambers.
