Area of Law

Clinical Negligence

I have long and considerable experience in this field. I now undertake cases of higher complexity and value, currently including, by way of examples of each:

• a claim arising from neonatal death of the new-born baby, which is an obviously serious and sensitive case meriting the instruction of leading counsel (QC) even though the damages likely to obtained for the bereaved and psychiatrically injured parents may be lower than would usually lead to a QC’s involvement, and

• a claim for cerebral palsy of a new-born who now requires lifelong full care, which is likely to result in an award > £20m.

Health and Safety, including Product Liability

I have long and considerable experience in product liability claims for injury, including most recently advising on successful claims in the ‘metal-on-metal hip litigation’.

Media and Entertainment

I do not generally undertake initial advisory work in media and entertainment matters, but am happy to act as strategic lead in test and appeal cases.

I have long and considerable experience in this field, particularly as to clinical/medical negligence, and solicitor’s negligence in conduct of injury claims.

Public and Administrative Law

I was Counsel General for Wales 2011-16, senior legal advisor to and member of the Welsh Government, advising on all aspects of constitutional, public and administrative law and legislative process, and appearing as lead advocate in the first 4 Supreme Court devolution reference cases 2011-14. I do not generally undertake initial advisory work in public law matters, but am happy to act as strategic lead in test and appeal cases.

I am Chair of Welsh Rowing and former Director of British Rowing, and have broad expertise in sports injury, safeguarding, disciplinary, governance and funding issues.

I have expertise in injury claims arising from sport, including currently advising in the issues of brain injury from repeat head trauma in football and rugby.

I can advise and appear in all forms of injury though as a leading counsel (QC and now KC) I undertake those cases at the more serious/complex level.

I cannot conduct litigation (which includes investigations, obtaining of expert evidence, and issuing and conducting court proceedings), though if litigation is required I can help you to find the best solicitor/lawyer who can conduct the case for you.

My role will be to provide you with initial advice of the highest expertise in this field, and guidance as to how best to proceed. I can then advise further and appear for you later on as agreed by you and your solicitor/lawyer.

It is possible for you to conduct litigation without the assistance of a conducting lawyer, but I will generally advise against this.
